1. Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and 3 Keys Homes, LLC, a limited liability company organized under the laws of the State of Alabama ("3 Keys Homes," "we," "us," or "our"), and govern your access to and use of threekeyshomes.com and any related pages or forms we operate (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not access or use the Site.

You represent that you are at least eighteen years of age and have the legal capacity to enter into this agreement.

2. Informational Purpose Only

Any interest 3 Keys Homes, LLC may offer at any time would be offered only through definitive written documentation, only to persons qualified under applicable law, and only in jurisdictions where such an offer is lawful. No such offering is being made through the Site.

No statement on the Site creates any contract, agency relationship, fiduciary duty, joint venture, or partnership between you and 3 Keys Homes, LLC. Submitting an inquiry does not create any obligation on either party.

4. Not a Brokerage or Lender

3 Keys Homes, LLC is a private principal. When we acquire property, we do so for our own account.

• We are not a licensed real estate brokerage, and we do not hold a real estate broker or salesperson license.
• We do not represent buyers or sellers, and we do not act as anyone's agent.
• We do not provide brokerage, property management, appraisal, escrow, title, or inspection services.
• We are not a bank, mortgage lender, mortgage broker, mortgage loan originator, credit repair organization, or consumer reporting agency, and we do not provide those services.

If you require brokerage representation, financing, legal advice, or a professional valuation, you should engage an appropriately licensed professional of your own choosing.

5. Fair Housing Commitment

3 Keys Homes, LLC complies with the federal Fair Housing Act (42 U.S.C. §§ 3601 et seq.) and all applicable federal, state, and local fair housing and nondiscrimination laws.

We do not discriminate, and will not discriminate, on the basis of race, color, religion, national origin, sex, familial status, disability, or any other characteristic protected by applicable law, in any aspect of our business, including the acquisition, improvement, sale, lease, financing, or advertising of housing.

6. Text Messaging Terms

If you provide your mobile telephone number and affirmatively opt in, you agree that 3 Keys Homes, LLC may send you text messages at that number.

• Consent is not a condition of any purchase, sale, service, or transaction.
• Message frequency varies.
• Message and data rates may apply, charged by your carrier.
• Reply STOP to opt out. Reply HELP for help.
• Carriers are not liable for delayed or undelivered messages.

You represent that the mobile number you provide is your own, that you are authorized to consent to receive messages at it, and that you will notify us promptly if it is reassigned or you no longer control it. You agree to indemnify us for claims arising from your provision of a number you were not authorized to enroll.

7. Your Submissions

You represent that any information you submit through the Site is accurate, that you have the right to provide it, and that providing it does not violate any law or the rights of any third party.

Do not submit confidential, sensitive, or privileged information through the Site, including Social Security numbers, financial account numbers, payment card numbers, or health information. We do not request such information through web forms.

You grant us a limited, non-exclusive license to use the information you submit solely for the purpose of responding to you and operating our business, consistent with our Privacy Policy. We claim no ownership of information about property you own.

8. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Submit false, misleading, fraudulent, or impersonating information;
• Enroll a telephone number you are not authorized to enroll;
• Attempt to gain unauthorized access to the Site, its servers, or related systems;
• Use any automated means, including robots, scrapers, or data mining tools, to access, harvest, or copy content or data from the Site;
• Interfere with or disrupt the operation of the Site or the networks supporting it;
• Transmit any virus, malware, or other harmful code;
• Reverse engineer, decompile, or attempt to derive the source code of any portion of the Site;
• Use the Site to send unsolicited commercial communications.

We may suspend or terminate your access to the Site at any time, without notice, for conduct we reasonably believe violates these Terms or applicable law.

9. Intellectual Property

All content on the Site, including text, graphics, logos, marks, photographs, icons, layout, and the selection and arrangement thereof, is owned by or licensed to 3 Keys Homes, LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

"3 Keys Homes" and associated logos are marks of 3 Keys Homes, LLC. You may not use them without our prior written permission.

You may view and print pages from the Site for your own personal, non-commercial reference. You may not otherwise reproduce, distribute, modify, publicly display, publicly perform, republish, or create derivative works from Site content without our prior written consent.

10. Third-Party Content

The Site may contain links to, or content sourced from, third parties. We do not control, endorse, adopt, verify, or assume responsibility for third-party content, products, services, or practices. Any dealings you have with a third party are solely between you and that third party, and we are not responsible for any resulting loss.

11. Disclaimer of Warranties

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless 3 Keys Homes, LLC and its members, managers, officers, employees, agents, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or relating to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or the rights of a third party, or (d) any information you submit through the Site.

14. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Alabama, without regard to its conflict of law principles.

You agree that any action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Shelby County, Alabama, or Jefferson County, Alabama, and you irrevocably consent to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.

Any claim must be brought within one year after the cause of action accrues, or it is permanently barred, except where a longer period is required by applicable law.

15. General Provisions

• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Site and supersede all prior understandings on that subject.
• Severability. If any provision is held invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries. These Terms create no rights in any third party.
• Headings. Section headings are for convenience only and do not affect interpretation.
• Survival. Sections 3, 4, 9, 11, 12, 13, 14, and 15 survive any termination of your use of the Site.

16. Changes to These Terms

We may modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be effective upon posting unless a later date is stated. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms. If you do not agree, your remedy is to stop using the Site.
